Is this another talented relatively unknown genius...who has not been nationally found yet?

Is this the guy who "lived out of his hippie Mom's car" in Luckenbach, Texas, as a kid growing up... with nothing to play with other than a six string guitar, that Monte taught himself to strum with what is considered a sublime level of style that makes most guitar players sit up and notice?

So you think you know music and can spot talent...huh?

My favorite Monte Montgomery album is "1st And Repair" (Tip: you have to spell it that way at Grooveshark) and you can hear the whole album free (from start to finish) without signing in at GROOVESHARK.COM.

I used to listen to this album over and over...and couldn't really describe how good these songs are together, in the order they were published. Just listen to the first four songs, and you'll like Monte and this album.

Lately, Glen Greenwald, summarizes the state of our sense and lack of sensibility in regard to quite an extensive and disturbing story that "really has not been appreciated" or reviewed by any other website, other than this blog (believe it or not).

I'm talking about extrajudicial neutralizations of lawyers, complainants, witnesses, and whistleblowers. I'm talking about "the death of due process blues" sang be me to the sound of not one hand clapping?

I'm referring to my own specific fact based assertions that are usually referenced by me, after cutting up mainstream media stories that always (somehow?) manage to leave out specific facts, personal pronouns or analysis of "who, what, when, why, how" suspicions.

Revisiting the yogurt shop murders: A cold case reconsideration of the 1991 crime points away from the prosecution's assumptions and conclusions

On Oct. 28, 2009, Travis County District Attorney Rosemary Lehmberg stood solemnly behind a lectern choked with microphones.

She had convened a press conference to deliver big news. Ten years after city and county officials gathered to announce that they'd found the four men responsible for the grisly 1991 yogurt shop murders, Lehmberg had decided to dismiss all charges against the only two men ever tried for the crime, Robert Springsteen and Michael Scott.

"Make no mistake, this is a difficult decision for me, and one I would rather not have to make," she told a score of reporters.

But it was the only real option.

Although she still believed Springsteen and Scott were responsible for the crime, she said – despite a lack of any physical evidence connecting them to it...

– ....she had concluded that she must drop the charges because prosecutors had no explanation for explosive new evidence discovered in 2008: unknown male DNA found on a vaginal swab collected at the 1991 crime scene from the youngest victim, 13-year-old Amy Ayers, that does not match Springsteen or Scott, nor the other two men officials say also took part in the crime, Maurice Pierce and Forrest Welborn.....

I cannot say for sure but, "this evidence only came forward under Brady" after, after, after....the FBI Director made a decision to "open a brief look" at my memo.

Despite any criticisms of Mueller by me made in the past...Mueller does have an open mind about things...and deserves credit for taking a look at this case using "fresh agents" not necessarily tied to "following The Central Texas LEO Group over the cliff".

I think that FBI sniffed around, and forced this info out of the closet. I do believe that it was withheld by Ronnie Earle's office. I do believe that it was a crime to withhold that evidence.

The good news is...you have DNA EVIDENCE.

So did this prosecutor identify the killer, or not?

Got to put her under oath with Ronnie Earle...no?

Sworn statements are far more legitimate then phone calls?

Body language is everything...no?

I still don't think this case is over...or should be considered solved (like The Christina Moore Murder and bogus half assed prosecution by John Bradley at Williamson Cty States Attorney Office).

It's not over when APD COMMANDER SHAUNA JACOBSON and Kurt, ended up dead over this. And a Judge also suicided (?).

I think The FBI in Austin or at HQ, do have something more to say about all this, because the case is not over or solved.

....Farrelly, Sawyer, and Garcia declined to divulge any specific details about the customers or what they said about the two men they saw, because the customers were never called to testify in court, but other sources with knowledge of the case have confirmed a basic account of what the final two customers, a married couple, told police happened on Friday, Dec. 6, 1991, just before 11pm. (Contacted by the Chronicle, the witnesses declined to comment for this story.)...

...Garcia says that he has offered to share with D.A. Lehmberg the timeline the defense developed, but to date, he says, she has not accepted that offer....

...Twenty-five to 27 percent of all exonerations ... involve false confessions; it is a fact that they occur. It is a fact that false confessions occur in Austin, Texas, with the Austin Police Department," Farrelly says. "And the fact that they won't even acknowledge that possibility is where they are going wrong."...

... the problems facing investigators now are precisely those expected when you "try to un-ring a bell," he says. "They want to connect it to those four because they're out on a thin limb, and I think it's been sawed off – according to them, it's only half-sawed off and we can regenerate that limb," he continued.
"There is an undercurrent that people want so desperately to believe that the police and that the legal system is right, that it would be a sign of weakness, or they would lose [public] confidence by admitting they're wrong."....

...Likewise, among the evidentiary details that have always caught her attention, Far?relly says, is the account offered by the owner of the party store next door, who said he didn't hear anything from the yogurt shop save for several popping noises – which the lawyers each assume was gunfire.

The fact that the shop was otherwise silent through a strip-mall wall suggests to Farrelly a certain amount of control over the victims, which she believes only would be possible had the assailants been grown men – and likely men with some previous criminal involvement.

Moreover, the systematic nature of the murders – all the girls undressed, multiple victims raped, the execution-style shootings, and the bodies stacked – suggests experienced, sadistic criminals with far more foresight and ruthlessness than likely for teenage boys.

Ultimately, what the defense lawyers and the current investigators have in common is a stated belief that the crime can be solved. The question – the final one that appears to separate the two camps – is how to get there. "If someone were to come in with an open mind, with no ties to the previous cold case ... and to look at the original investigation ... I think they would come up with a different theory," says Farrelly. "And I think that they would be on the right path."

The FBI brought in special agents to look at this.

MUELLER did have an open mind on this, and did probably note that it was expedient and wise to "use out of state agents with no ties to Central Texas LEO".

So...with the FBI using my memo, they did notice the timeline evidence of "my posting of the memo" at AUSTIN IMC (in front of Austin FBI and Austin PD's surveillance eyes of this activist website) and the untimely and suspicious death of APD COMMANDER SHAUNA JACOBSON and her husband Kurt. Shauna was tied to this case.

Nothing in this news story mentions this key timeline evidence?

And, no comment about another name in the memo (an appeals judge) who also had an untimely death (suicide)?

FBI might have more to say about this...the case is not over.

Did the two assailants know the girls?

They were allowed to use the bathroom...because the assailants knew the girls...right?....does any stranger get to use the bathroom or is that just for friends?

Would other "late night Yogurt slurpers have a routine" that could tie the assailants to other nights of banter with the girls?

FBI has access to NCIC crime data......so.......how many "arson murders with multiple victims involve stacking the bodies" and "why stack bodies"?

Stacking bodies in front of large windows at a strip mall?

Was the crime scene cased before the crime?

Was a silencer used? Popping noises? Did this witness see or hear any vehicles after the popping noises?

Any phone call evidence (called and recieved) on previous nights leading to an address close by (Moebius info memorialized in my complaint)? Multiple calls? Emails to and from girls a month before the crime?

What was the insurance pay out angle?

Who got paid?

Was this linked to The Pizza Hut (Lt. Hector Polonca) murder of Nancy DePreist? Who got paid? Where did that money go? Under Moebius' theory, the money paid gets moved and shared...no?

Why this particular night, when the assailants had already talked to a cop...and they did not get spooked? How confident and risky is it for the assailants to "usher other customers ahead in line" and "was that done so the assailants were last in line" and hopefully last in the shop (the goal all along)?

This cop (Dearl Croft) is a key witness who had his instincts working and "had a funny feeling" about the guy he talked to on that night, so...hypnosis to pull all facts from this cop?

What about vehicles? Did the assailants walk from a nearby apartment, or drive? Where was the car parked that was driven by the next door neighbor running The Party Store near the murder scene?

How many professional or seasoned murderers "stack bodies"? Why stack bodies like cord wood? How do you rape, control, murder, and stack bodies....at a strip mall with large windows allowing visibility?...and...uh...didn't the murderers try to avoid witnesses (like the next door business owner)?

Did one of the two assailants (who sat at the table that did not have a chair on it as part of the "closing the store modus") live next door?

Was Eric Moebius's theory about insurance fraud correct?

APD COMMANDER SHAUNA JACOBSON was credited with solving the case when supervising the cold case detective's work. She got my memo. What did she do next? Didn't she want to reopen the case broadening it into insurance fraud? Did she get shut down by Chief Stan Knee? Did she talk to the female Austin FBI agent?
Why were The Jacobson's death, part of a timeline, with a subtle cover up by Knee using and paying ARCHIE CARL PIERCE to write a report? Was that necessary? Who thought an outside source was needed to close the Jacobson death spin control?

What happened to the court room excited utterance by Kenneth Wayne McDuff who fingered Worley in The Yogurt Shop Murders? Was that correct? Did the DNA match Worley or McDuff?

Who did The Nancy DePreist murder at The Pizza Hut? Was that his (Joseph Achim Morino in Texas State Pen) first capital crime, and "was he involved with the occult" and does he have something to say that supports Moebius' theory on insurance fraud?

What did FBI get from Morino (who came to christ while serving life) about other crimes committed with what other unindicted coconspirators?

Wasn't Nick Milam an attorney who supported Moebius' theory, and wasn't he run out of town by SAN ANTONIO FBI working with INSURANCE COMPANY INVESTIGATORS (as reported by Bill Conroy at The San Antonio Business Journal)?

What did Stan Knee say to The FBI on all this?

Austin Police shot and killed former yogurt shop defendant Maurice Pierce around 11pm Thursday night, after pulling Pierce over on a traffic stop in North Austin.

According to APD, Pierce ran a stop sign near Parmer Lane and McNeil Drive around 10:54p. After pulling over, officials say Pierce got out of the car and fled on foot. One officer -- Brad Smith, a rookie -- followed Pierce in a patrol car, while a second, five-year veteran Officer Frank Wilson, pursued Pierce on foot to the 12800 block of Carrera..............

New Bill Authorizes Rendition of American Citizens Living On U.S. Soil to Other Countries for Torture

Top experts – including the sponsors of the bill – say that the newly-passed National Defense Authorization Act authorizes indefinite detention of Americans living within the United States.

Top legal experts point out that the government claims the right to assassinate American citizens on U.S. soil without any charges, trial or other constitutional protection.

I noted last month that Congress was considering repealing prohibitions against torture. (I wrote to attorneys at the ACLU, but haven’t received word yet on whether such a provision has been enacted).

However, Mother Jones notes today that Congress has explicitly authorized rendition, allowing American Citizens on U.S. soil to be sent to other countries which do torture:

A defense spending bill that passed both houses of Congress overwhelmingly and is set to be signed by President Barack Obama as early as this week could make it easier for the government to transfer American terrorist suspects to foreign regimes and security forces.

The National Defense Authorization Act (PDF) contains a section that says the president has the power to transfer suspected members and supporters of Al Qaeda, the Taliban, or “associated” groups “to the custody or control of the person’s country of origin, any other foreign country, or any other foreign entity.”

That means if the president determines you’re a member or supporter of Al Qaeda or “associated forces,” he could order you to be handed over to the Saudis, the Egyptians, the Yemenis (“any other foreign country”), any of their respective security forces, or even the United Nations (“any other foreign entity”). (You can read the relevant section of the law in the document viewer at the end of this article; look for the highlighted annotations.)

[Daphne Eviatar, a lawyer with Human Rights First] adds that there are “a whole lot of scenarios” where the government might want to transfer a suspected terrorist—even a US citizen—to foreign custody. For example, the administration might not want to go through the political mess of determining whether to send a suspect to Gitmo, try him in a military commission, or use the civilian system. The administration might also want to avoid the mandatory habeas corpus review that would come if the US held the suspect itself. In such a case, transferring the suspect to a foreign security force might present an appealing option.

Forensic Examiner Found No Match of Cables on Manning’s Laptop to WikiLeaks’

MEADE, Maryland — A day after a government forensic expert testified that he’d found thousands of diplomatic cables on the Army computer of suspected WikiLeaks source Bradley Manning, he was forced to admit under cross-examination that none of the cables he compared to the ones WikiLeaks released matched.

Special Agent David Shaver, a forensic investigator with the Army’s Computer Crimes Investigations Unit, testified Sunday that he’d found 10,000 U.S. diplomatic cables in HTML format on the soldier’s classified work computer, as well as a corrupted text file containing more than 100,000 complete cables that had been converted to base-64 encoding.

Six months after Manning was arrested for allegedly leaking documents to WikiLeaks, the site began publishing 250,000 U.S. diplomatic cables that ranged in date from December 1966 to the end of February 2010. But Shaver said none of the documents that he found on Manning’s computer, and that he then compared to those that WikiLeaks published, matched the WikiLeaks documents...............

Why Do People Defend Unjust, Inept, and Corrupt Systems?

ScienceDaily (Dec. 12, 2011) —

Why do we stick up for a system or institution we live in -- a government, company, or marriage -- even when anyone else can see it is failing miserably?

Why do we resist change even when the system is corrupt or unjust?

A new article in Current Directions in Psychological Science, a journal published by the Association for Psychological Science, illuminates the conditions under which we're motivated to defend the status quo -- a process called "system justification."

System justification isn't the same as acquiescence, explains Aaron C. Kay, a psychologist at Duke University's Fuqua School of Business and the Department of Psychology & Neuroscience, who co-authored the paper with University of Waterloo graduate student Justin Friesen. "It's pro-active. When someone comes to justify the status quo, they also come to see it as what should be."

Reviewing laboratory and cross-national studies, the paper illuminates four situations that foster system justification:

----system threat;

----system dependence;

----system inescapability;

---- and low personal control.

When we're threatened we defend ourselves -- and our systems. Before 9/11, for instance, President George W. Bush was sinking in the polls. But as soon as the planes hit the World Trade Center, the president's approval ratings soared. So did support for Congress and the police. During Hurricane Katrina, America witnessed FEMA's spectacular failure to rescue the hurricane's victims. Yet many people blamed those victims for their fate rather than admitting the agency flunked and supporting ideas for fixing it. In times of crisis, say the authors, we want to believe the system works.

We also defend systems we rely on. In one experiment, students made to feel dependent on their university defended a school funding policy -- but disapproved of the same policy if it came from the government, which they didn't perceive as affecting them closely. However, if they felt dependent on the government, they liked the policy originating from it, but not from the school.

When we feel we can't escape a system, we adapt. That includes feeling okay about things we might otherwise consider undesirable.

The authors note one study in which participants were told that men's salaries in their country are 20% higher than women's. Rather than implicate an unfair system, those who felt they couldn't emigrate chalked up the wage gap to innate differences between the sexes. "You'd think that when people are stuck with a system, they'd want to change it more," says Kay. But in fact, the more stuck they are, the more likely are they to explain away its shortcomings.

Finally, a related phenomenon: The less control people feel over their own lives, the more they endorse systems and leaders that offer a sense of order.

The research on system justification can enlighten those who are frustrated when people don't rise up in what would seem their own best interests. Says Kay: "If you want to understand how to get social change to happen, you need to understand the conditions that make people resist change and what makes them open to acknowledging that change might be a necessity."

White House drops veto threat over detainee legislation

After initially threatening a veto, the White House has issued a statement saying changes made by the House and Senate regarding controversial detainee provisions are sufficient and advisors will no longer advise the president to veto the 2012 Defense Authorization bill if it passes the House and Senate.

The detainee provision sought to codify rules that would mandate that the military would hold in custody and try terror suspects. That concerned the White House and many lawmakers who think the responsibility belongs, in part, to law enforcement agencies and the federal courts and warned that Americans could possibly be detained indefinitely by the military.

The White House reversal comes on the same day that the FBI Director Robert Mueller told a Senate committee hearing that while some of the changes are helpful, the provisions regarding what happens at the time of an arrest "lack clarity" and did not address all of his concerns about the ability to gain cooperation after an arrest.

"It lacks clarity with regard to what happens if - we had a case in Lackawanna, New York, and an arrest has to be made there and there's no military within several hundred miles," Mueller said.

Mueller said it is an issue too when FBI and military can both be on the scene.

The real definition of Terrorism

The word that simultaneously means nothing and justifies everything.

....Few things better illustrate the utter meaninglessness of the word Terrorism than applying it to a citizen of an invaded country for fighting back against the invading army and aiming at purely military targets (this is far from the first time that Iraqis and others who were accused of fighting back against the invading U.S. military have been formally deemed to be Terrorists for having done so).

To the extent the word means anything operationally, it is: he who effectively opposes the will of the U.S. and its allies.

This topic is so vital because this meaningless, definition-free word — Terrorism — drives so many of our political debates and policies.

Virtually every debate in which I ever participate quickly and prominently includes defenders of government policy invoking the word as some sort of debate-ending, magical elixir: of course President Obama has to assassinate U.S. citizens without due process: they’re Terrorists; of course we have to stay in Afghanistan: we have to stop The Terrorists; President Obama is not only right to kill people (including civilians) using drones, but is justified in boasting and even joking about it, because they’re Terrorists; of course some people should be held in prison without charges: they’re Terrorists, etc. etc.

It’s a word that simultaneously means nothing and justifies everything.

Wayne Madsen has learned from his contacts within the Beltway intelligence community that Jared Lee Loughner is an “MK-ULTRA” programmed assassin and that US District Judge John Roll and Congresswoman Gabriel Giffords were targetted for assassination.

The reason for the decision to target Judge Roll and Congresswoman Giffords has to do with their knowledge of the malicious and purposeful arming of Mexican drug gangs along the US-Mexico border by US intelligence agency assets in an effort designed to destablize the Mexican government.

This towards the end of making Mexico more dependent on US military aid and protection from its private security contractors.

The Senate Armed Services Committee, led by Senators Carl Levin (D-Michigan) and John McCain (R-Arizona), approved the bill despite its provisions for military detention of any suspect (even those apprehended within the United States) accused (not proven) of involvement in any terror-related offense. Presumably, military detention would include those accused of offenses as innocuous as "lying to a federal agent," unrelated to actual terrorism yet classified as terror-related.

The most glaring problem with the committee's legislation is its violation of our nation’s most fundamental values shared across our political spectrum.

First, the committee’s proposal accepts prosecutors as the arbiters of guilt. We have courts in America to check executive power. Impartial judges limit over whom the state may exercise its coercive power to deny freedom. We don’t trust prosecutors to make those decisions, because we presume innocence. Being considered "innocent until proven guilty" is a bedrock constitutional norm, a cornerstone in the edifice our Founders constructed to defend freedom from the potential tyranny that Levin & McCain casually invite.....

A separate fundamental principle restrains the military from operating domestically. Levin and McCain invite domestic military deployment.

Beyond its blatant violation of fundamental American principles, Levin and McCain also play loose with the system. Their bill passed the Armed Services Committee essentially in secret, without even a single hearing on their radical and seemingly Soviet-inspired proposal.

Moreover, their committee overstepped its jurisdiction, invading the spheres of the Judiciary and Intelligence Committees. Senators Patrick Leahy (D-Vermont) and Dianne Feinstein (D-California), who chair those committees, raised their voices in protest--and Senator Mark Udall (D-Utah) introduced an amendment that would reverse Levin-McCain’s detention provisions. Even within a single, insular, tone deaf political party, the left and right hands actively work at cross purposes.

We live in a nation where, apparently, we enjoy no electoral alternative to human rights abuses. Will the real Americans please stand up?...

Even worse than the betrayal of Democrats, however, is the betrayal of Congress--by itself. The central theme of the Constitution is its system of checks & balances to limit executive power and prevent tyranny.

But rather than resist executive power, today’s congressional leaders actively expand it. This article about a "candle in the wind" (Elton John's song about Marilyn Monroe) took the story angle from another orphan who saw her one day outside a cafe. He nervously approached to offer his card to shoot some test photos.

This shutterbug (Bruno Bernard)...actually "got the ball rolling" for Monroe...making the friendship and "crucial introduction" to a vice president of a talent agency who "helped Marilyn make her dreams of fame come true".

This contact (Vice President of a Talent Agency who first signed Marilyn) of Hollywood photographer, Bruno Bernard also "couldn't help but snap photos" of her, like a drooling lunatic on his first introduction.

Marilyn, while famous and on set...always tipped her hat to Bruno for all he had done.

A guardian angel that opened doors for a candle in the wind?

It's "not who you know...more like it depends on how photogenic you are"...no?

Lawyers for Alleged Narco-Boss Zambada Niebla Claim Prosecutors Suppressing Evidence By Invoking National Security

The criminal case against accused Mexican narco-trafficker Jesus Vicente Zambada Niebla now appears to be threatening to unravel the U.S. government’s ugly national-security interests in the drug war.

Zambada Niebla, son of one of the leaders of the Sinaloa “Cartel,” arguably the most powerful international narco-trafficking organization on the planet, argues in his criminal case, now pending in federal court in Chicago, that he and the leadership of Mexico’s Sinaloa drug-trafficking organization, were, in effect, working for the U.S. government for years by providing US agents with intelligence about rival drug organizations.

In exchange for that cooperation, Zambada Niebla contends, the US government granted the leadership of the Sinaloa “Cartel” immunity from prosecution for their criminal activities — including the narco-trafficking charges he now faces in Chicago.

The government, in court pleadings filed last month, denies that claim but at the same time has filed a motion in the case seeking to invoke the Classified Information Procedures Act (CIPA), a measure designed to assure national security information does not become public during court proceedings.

To date, the US mainstream media has been completely silent on the US government’s effort to invoke CIPA in the Zambada Niebla case;.....

No Matter How Hard We Try To Forget

Forty-two years ago I was in South Vietnam, serving as a Marine infantryman. What does this mean? Is 42 years “a sea of time?”

To me, I am still the same. I am just as stupid, certainly, and am willing to delude myself into believing I could do now, what I could do then. Maybe I could.....

..... There were no dry socks. We didn’t wear them. Nobody wore underwear, it would rot off. Laundry was a combination of rain and walking through water. Bathing was pretty much the same also.

I remember getting on a scale while heading up toward the deck. It said “289 pounds.” Over half that was gear, part of it the life preserver the Navy made us wear. It must have weighed 20 pounds. If you dropped it in the water, it would sink like a rock.

This describes Vietnam, describes the Marine Corps pretty well. 90% acting, 90% phony and 10% doing the fighting and dying. With that came exhaustion, thirst, starvation and some anger. We could feel how much the Marine Corps hated us, how much America hated us.

No military was ever sent to perform a more corrupt and stupid task than ours at that time, or so I believed then.....

....Vietnam. It was a war fought by the poor, the patriotic, by my current definition, interchangeable with “insane,” and the wildly adventurous.

What it wasn’t fought by was the military. They sat that one out, letting draftees and “disposable” short term enlistees do all the combat duty. Regular military tended to stay behind, living in a world of barbed wire enclosures, “skivy girls” and the hum of air conditioning.

Those who really fought the war left immediately, ran for the door the second they could get away from the Marine Corps. They saw reality, a war fought by walking skeletons, a war without decent weapons, never a hot meal, not even Christmas, sleeping on the ground every day and watching friends die off one by one.

The “real Marine Corps” was what you saw if and when you got back to a base. To us they looked like pigs, fat, pink and overdressed........

....We remembered in training, the day assignments were given out. Some guy who couldn’t read would be assigned to an “Intelligence School” while those who refused to accept commissions were relegated to “WestPac ground forces infantry replacement 0300.”

By the end of boot camp, we knew what this meant and none of us wanted it. It was a sentence of death. In 8 weeks, we learned alot. We learned about the real military, corruption, incompetence, laziness. Marine drill instructors were hand picked, “dressed to the 9′s,” and of an ilk we would never see once leaving training.
Our real senior NCO’s with some exceptions, were uniquely unexceptional, rural, uneducated, unmotivated, alcoholic and never ever ever to be seen in combat......

....Do I mean the Marine Corps had no exceptional people? Not hardly! I was with nothing but exceptional people. They would be the best people I would ever meet, though I didn’t know it then.

Half wouldn’t survive.

Of those who did, some did exceptionally well, despite catastrophic injuries, certain psychological peculiarities of the combat vet, despite alot of things.

My squad, my platoon would be my family all of my life, a family that lived mostly in memories. A few of us stay in contact, now speaking rarely, years between even emails. Some families are like that. More of it, I think is that those of us who are still around, the numbers are miniscule, are having a bit of trouble holding on.....

....Of course, by now, I simply see Vietnam all over again, an army destroyed, veterans filling prisons, living under bridges, losing their families. “Then” we were divided. Vietnam was fought by “liberals.”

Combat vets were all Democrats, the guys who lived in the rear, the guys who watched us go off to fight the war, they were Republicans.

There were clear political lines, then, a freer press, a freer America. We recognized class war when we saw it. Real war is always class war, poor fighting to make rich people richer. If you don’t know it when you join up, you know it before your first week of training is over, at least we all did....

It took the current crop of veterans a few years to catch up but they are getting there. Where “there” is, now, that’s a question. Vietnam vets came home and fought to end the war. It wasn’t just a few. Not all were activists but all of us, the combat vets, were “anti-war.” Every single one of us.

Every combat Marine I met in Vietnam, every single one, was against the war. All thought it was insane because only a total moron could miss that. Vietnam was a tragic farce.

Those who speak of it differently, huge numbers of them, either weren’t there and lie about it or went through a process of institutionalization. I won’t dwell on this much.

Few surviving veterans of Vietnam were real combat vets. Those who were, I am one, would rather have cooked food, driven a truck, I didn’t resent the others. I wanted to be them. When I got back, when we got back, they were still our brothers, we had no reason to think otherwise.

Then time went on and war became “glorious” again.

Mankind began the evolutionary descent again.....

...I remember real combat. First times out, paralyzing fear. After that, you just don’t care anymore.

After that, you are dead inside, a “dead” that never goes away. Real combat vets call the look that comes with that “the thousand yard stare.”

I can kill someone as easy as looking at them.

We all can but we work to convince people otherwise.

We all became actors.

What we also learned was how to “not kill.”

Killing requires “reasons.”

Anyone who believes “reasons” is nuts.

Anyone really in combat knows who needs killing.

We also know we can’t talk about it.

I won’t talk about it here or ever.

I simply go on pretending to be a “real person” like everyone else except that I know the difference.

You'll notice that at dusk or dawn, you can get long shadows on the figurines. And, those shadows are an added attraction to the shot.

You can try different angles to catch the plattoon coming at you...or from a flanking angle.

With all art forms.............you're only limited by your own creative limitations.

Attorney Geoffrey Fieger won a dramatic acquittal Monday on federal charges of violating campaign-finance laws, saving his lucrative career and sending federal prosecutors in Detroit to yet another crushing defeat in a high-profile case.

Jurors rejected each of the felony charges against Fieger and his law partner, Vernon (Ven) Johnson, and then eight to 10 of them repaired to a downtown Detroit hotel to hoist glasses of champagne with the two defendants and their legal team.

“I want to thank the jury for listening,” Fieger said after the jury announced its verdict. It came after nearly 20 hours of deliberations over four days and a 20-day trial in U.S. District Court. “I hope this puts an end to political prosecution in the age of Mr. Bush,” referring to President George W. Bush’s administration.

Johnson and Fieger hugged family members, supporters and their lawyers after the jury cleared them. A conviction on any one of 10 felony counts against Fieger, and five against Johnson, could have sent them to prison and ended their legal careers.

The verdict was a victory for famed Jackson, Wyo., lawyer Gerry Spence, 79, who told jurors in closing arguments that his defense of Fieger was the last trial of his career..........

Depoe Bay, Oregon at dusk. The Coastal Highway goes right through the main street shopping area with an unobstructed view of the ocean. A town on the edge of the ocean.

This the infamous Portland surfer beach on The Oregon coast. OSWALD WEST. South of Tillamook. You walk down through an old growth Cedar Forest....to a rocky, log strewn sand beach. As far as I can tell........it's the best beach on The Oregon coast.

Gold Beach, Oregon...is infamous as a wind surfer paradise.

Humbug Mountain State Park...has a hiking trail over to this beach. It's in between two of my favorite towns on the coast, Port Orford and Wonderful Gold Beach. Both towns are on the edge of vast National Forests. Lots to see there. Crystal blue clear streams and rivers....old growth trees....and plenty of gravel roads to get lost on.

About 20 miles east of Gold Beach, is a National Forest road leading to what appears to be an ancient indigenous tribal amphitheatre. Protected by old growth trees...this rock formation leads to meditation on all fronts.

Quartzsite police firings case to move to federal court

In front of a packed courtroom Monday, Judge Randolph Bartlett allowed a hearing on the Quartzsite police officer firings to continue, despite a motion from an attorney for the Town of Quartzsite questioning the legality of the proceedings.

The hearing followed a temporary restraining order issued by Bartlett in recent weeks which ordered the town to reinstate two police officers who were fired following 10 out of 13 police officers being placed on paid administrative leave.

The officers had submitted allegations against their police chief Jeff Gilbert.

The Town of Quartzsite argued in court that agreements between employees and employers cannot be the subject of intervention by the court.

Bartlett allowed the hearing to proceed.

An attorney representing the police officers called Police Chief Gilbert to the stand. The town’s attorney responded by saying that he was not present in the courtroom, which drew an audible response from the 60+ crowd sitting and standing in the courtroom. The officers’ attorney then called Quartzsite Councilman Joe Winslow, who was also not present.

Since none of the defendants were present, the attorney called a plaintiff, Sergeant William Ponce, to the stand.
Ponce testified that he and 9 other officers had made allegations of an ethical nature about Chief Gilbert, and that he had subsequently been fired..............

If you don't know about this case....then....just find the two documentary films about the case.

Very disturbing.

No other documentary film....had me on the edge of my seat longer...and no other films kept me in a funk focusing on "...just how easy it is, to frame, scapegoat, and prosecute literally anyone for any heinous crime".

The fact that it took 18 years for the state to make an admission against their own interest......is equally disturbing.

I cannot imagine how anyone could be allowed to work criminal cases as a judge or lawyer or investigator....without reviewing these two films.

Police Say They Can Detain Photographers If Their Photographs Have 'No Apparent Esthetic Value'

Apparently the police in Long Beach, California, have a policy that says if a police officer determines that a photographer is taking photos of something with "no apparent esthetic value," they can detain them.

This revelation came after photographer Sander Roscoe Wolff was taking the following photo:

The police officer somehow determined that there couldn't be esthetic value there, and thus, the photographer had to be detained and checked out.

The police are defending this policy, saying that while officers don't have any specific training in what qualifies as "apparent esthetic value," they will stop anyone photographing things they don't consider to be something a "regular tourist" would photograph.

Wallabies have been observed acting strangely in poppy fields

Australian wallabies are eating opium poppies and creating crop circles as they hop around "as high as a kite", a government official has said.

Lara Giddings, the attorney general for the island state of Tasmania, said the kangaroo-like marsupials were getting into poppy fields grown for medicine.

She was reporting to a parliamentary hearing on security for poppy crops. ....

Retired Tasmanian poppy farmer Lyndley Chopping also said he had seen strange behaviour from wallabies in his fields.

"They would just come and eat some poppies and they would go away," he told ABC News.

"They'd come back again and they would do their circle work in the paddock."

Some people believe the mysterious circles that appear in fields in a number of countries are created by aliens. Others put them down to a human hoax.

Calling all shutterbug photographers....looking to cover the unusual and weird acts committed in The Ten Great Western States.

On July 31st, Priest River, Idaho...hosts lawn mower drag races down mainstreet at the annual Lumberjack festival. These small towns, usually throw pretty good parties to celebrate the end of brutal winters and overcast wet spring.

After the brutal winters, and wet "johnny come lately" spring....madness breaks out in little river towns.

The spotlight is on PRIEST RIVER, IDAHO.

Lawn mower racing, is moving onto the drag strip.

Vegas bookies named "Lefty" and "The Turk" are already booking rooms to cover the action.

It should be a drunken nuthouse....so you can count on me capturing the moment.

Like a Bobcat that can hear a field mouse's fart from 300 yards away...I've honed in on this truely new and American form of "kinetic art".

It was not too long ago, when...I was driving up to the summit above Hell's Canyon, west of White Bird, Idaho.....shooting some flower photos in the Forest.

These dogs...were off the leash.

In the past, I warned THE SURVEILLANCE TO "NOT FOLLOW ME DOWN GRAVEL ROADS AT NIGHT WITH GUNS" AND DO NOT DISTURB MY QUIET ENJOYMENT OF MY RIGHT TO ENJOY THE NATIONAL FOREST LANDS....especially DOGS OFF THE LEASH, IN MY CAMP?

Two days later, the same truck and same guy with same dogs....again....came into my parking site-camp site.

The guy for HOLDER TO SUBPOENA IS...IDENTIFIABLE.

Prior to this incident....On July 3rd, outside of Grangeville, Idaho...I had two teenage boys park next to my dispursed campsite, so they could play their music loud...while I was getting ready to sleep. They also had a loaded deer rifle with them?

America is bracing itself for a series of investigations that could see top officials from the administration of President George W Bush hauled in front of Congress, grilled by a special prosecutor and possibly facing criminal charges.

Several investigations will now cast a spotlight on Bush-era torture policy and a secret CIA assassination programme, examining the role played by big names such as the former vice-president Dick Cheney and the former defence secretary Donald Rumsfeld.

In one investigation into the controversial firing of federal prosecutors, Bush's political guru, Karl Rove, has already been forced to appear before Congress and give testimony behind closed doors.
Another investigation, by the House of Representatives' intelligence committee, has already asked for documents from the CIA and has now announced that it will examine the legality of keeping a secret CIA hit squad hidden from Congress, something alleged to have been ordered by Cheney himself.

"I intend to make this investigation fair and thorough," said the committee's chairman, Texas congressman Silvestre Reyes late on Friday.

The moves reveal a long-awaited desire by elements of the Obama administration and Democrat-controlled Congress to examine alleged abuses of power by Bush officials. The inquiries also seem to go against the wishes of some in the White House, including Barack Obama.

But Obama may not have too much say in what could be the most explosive investigation: one set to be launched by the attorney-general, Eric Holder. Any such prosecutor could have the power to bring criminal charges.

Another report, to be released in the next two months, is being compiled about top officials in the Justice Department who drew up legal advice that justified the new interrogation techniques. That probe focuses on John Yoo, a former deputy assistant attorney general and Jay Bybee, a federal judge.

Many insiders think public reaction to those two reports is likely to ensure that Holder eventually appoints a special prosecutor, similar to Kenneth Starr, who investigated Bill Clinton's affair with Monica Lewinsky. "I think it is likely that Holder will do that," said Larry Johnson, a former senior CIA official.

At the same time, other senior politicians in Congress are investigating the CIA's activities in the Bush era, especially allegations that it kept hidden a secret assassination squad aimed at top al-Qaida figures. The Senate could announce its own investigation alongside the House one already now going ahead. Both could subpoena officials, perhaps including Cheney.

One member of the House committee, New Jersey congressman Rush Holt, told his local newspaper that the inquiry should be as intense as the that of the committee which investigated Watergate.
"I think any new investigation will produce revelations that are as jaw-dropping as those that were uncovered by the Church committee," Holt said.

These fresh investigations would add to some already under way. Rove is expected to be called again for further questioning later in the summer. Obama has ordered his national security officials to examine allegations that Bush officials resisted efforts to investigate a massacre of hundreds of Taliban prisoners in 2001 by an American-backed Afghan warlord. "I've asked my national security team ... to collect the facts for me that are known and we'll probably make a decision ... once we have all the facts," Obama said during his recent trip to Africa.

A series of hard-hitting investigations will be celebrated by many on the liberal wing of the Democratic party and human rights activists.

Others say protracted investigations will sap Obama's political capital at a time when he faces a difficult battle over healthcare reform. Jon Corzine’s campaign has spent the last several days raising questions about alleged political interference in the U.S. Attorney’s office under Republican Christopher Christie. Corzine alleges that phone conversations between former White House political operative Karl Rove and Christie while Christie was still serving as New Jersey’s top federal prosecutor cast doubt on the prosecutorial decisions made by the office during Christie’s entire tenure.

But Corzine’s message may have been pre-empted by his own party last month when former Christie deputy Adam Lurie was hired by the House Permanent Select Committee on Intelligence to head the committee’s official investigation into an alleged secret CIA assassination program.

Lurie spent four years as an Assistant U.S. Attorney in the Special Prosecutions Division of Christie’s Newark office. Committee co-chairpersons Silvestre Reyes (D-TX) and Jan Schakowsky (R-IL) lauded Lurie’s credentials and the experience he gained serving under Christie. Schakowsky called Lurie’s background “impeccable.” But it was Reyes’ praise for Lurie that may prove troublesome for Corzine’s current campaign strategy of attacking the integrity of Christie’s office.

“I am pleased that Mr. Lurie has accepted this challenge at such a critical time in the history of the Committee. His experience as a public integrity prosecutor demonstrates that he is capable of conducting apolitical, non-partisan investigations,” said Reyes. “I am confident that he is dedicated to conducting the fair, methodical, and complete investigations that will best serve all members of the Committee.”

Reyes’ effusive praise of Lurie leaves Corzine to explain how Christie’s deputy could have served in such an “apolitical, non-partisan” manner while serving in Christie’s allegedly politically charged office. There's alot of bad blood in Quartzite, Arizona.

My second complaint...mentions the INTERSTATE STALKING BY BOB MUELLER'S FBI using vigilante networks known as INFRAGUARD (created by Bob Mueller) and NEIGHBORHOOD WATCH GROUPS.

Holder is clearly not telling the truth about his role in Gunrunner. He knew about it, boasted of it and took credit for it. Now he's orchestrating a cover-up of it. The citizenry of Troy, Idaho...gathered under the haze of quite a few beers...as modern day knights of the round table...entered the arena to the sound of lawn mower engines rodded out by taking the governor off the carb.

Of course, the pits were where the races are always won.

The track was perfectly groomed to provide plenty of hay bales to maximize an unobstructed view for the crowd

This was the guy, who seemed to have perfected tweeking his engine to get the most speed....and he had the tires spinning and kicking out rooster tails of dirt. I saw him lift the front wheels off the ground on most of the turns? I suppose, a little high octane aviation fuel...can do wonders for any engine...no?

Somewhere in the high prairie grass East of The Hells Canyon in Idaho...is a little wood cutting, deer hunting, cowboy town, that's seen a lot of wilderness isolation from the worst influences that America spawned.

It's a little piece of Norther Exposure (Sicily, Alaska) with May berry RFD...in a true, verdant, green, canyon land part of The Western Mountain States (far removed from Aspen, Durango, Vail, Jackson and all that phony rich boy jazz).

It's called Grangeville, Idaho. Right next to vast tracts of National Forest lands and clear water rivers full of fish. It's also next to The Nez Perce Indian Reservation. The Nez Perce, actually helped Lewis and Clark, and were led by a famous chief who was well schooled and talked like a lawyer.

They named a canyon after him, "Lawyers Canyon".

Yup.

Another memorable hero from this area was a Nez Perce Cowboy named JACKSON SUNDOWN.

One of the best rodeo cowboys who was rarely allowed to win by a racist white power structure handing out the rodeo money.

At one rodeo, a riot ensued over the politicized judging that impugned western concepts of fundamental fairness. He was famous for cutting up his winnings (after they finally let him win) with a Buffalo soldier (black American) who, in Sundown's estimation, rivalled and may have equaled Sundown's rodeo skill on that day.

Anyway, BORDER DAYS, is a small town cowboy pageant, with quite a few cowgirls.

This is a sketch I cranked out...while (oddly enough) rereading ERNEST BECKER'S "ESCAPE FROM EVIL" (considered by Becker as a companion second encore after his monumental "DENIAL OF DEATH").

This is a modern...slanting flat roof...cabin/home/crib.

The front has an recessed porch facing the East sun in the morning.

Big windows up front...like the kind you see at big Medical centers.

Of course...I need to add a fireplace...one that is effecient (most fire places are good at moving heat up and out and ...uh...very ineffecient).

The bottom or first story is all brick, or flat rock...as a faux finish around a traditional and cheap method.

There is a big basement level...for a TV room...with open walls. No dividing up space man...need to see from one load bearing wall to the next.

It is a bachelor pad. Just cats for me. I'm like Bill Mahrer (the comedy guy).

I Triumph, in solitude.

No walls to cut off the open quality.

The goofy square's on the slanting roof....are actually a porch on the roof (?)...that you access from a winding staircase.

The driveway is a circular driveway...under the roof....no garage...just a slopeing roof.

Perhaps, a pool paralleling the far east and south 90 degree angle.

I would landscape with a look at Japanese gardens. Lots of furrowed pea gravel to rake...or maybe some fine white sand?

I'll see if I can develop this with some colors....showing the Kentucky blue grass around the house.

One wild card...is the lot. The slope of the land...is always important...and...a knoll or small hill, would be best...with a long (at least a quarter mile) long gravel road leading up to this abode.

Some times, reading Becker.......the mind wonders to modern architexture?

The criminal syndicate responsible for massive drug moves using two planes from St. Petersburg, Florida—a DC9 caught carrying 5.5 tons of cocaine and a Gulfstream II busted eighteen months later with four tons—include among its number at least two well-known Americans whose names have not previously surfaced.

One is a man present at the inception of a political scandal which swirled for several decades around what was, at least until recently, the world’s most infamous bank: BCCI, the Bank of Crooks & Criminals International.....

The idea that Bert Lance, or former top U.S. military officials Major General Richard Secord and Air Force Brigadier General Heinie Aderholt were associates of a criminal syndicate using American planes to haul tons of cocaine up from South America while simultaneously involved in massive financial fraud may not be as shocking as it once was.

What does seem improbable, however, is whether, even if true, it would become breaking news. When was the last time anyone heard of an American General being arrested for anything?

The DEA Enters the Twilight Zone

But not so fast... Venezuela’s Hugo Chavez plans to get there first.

And there-in lies the rub.

Mackled's wanted in Venezuela in connection with the murder of several rivals as well as a journalist. And the U.S. and Venezuela are now engaged in an unseemly tug-of-war over which nation gets to pick over Makled’s carcass first.

In fact, the stakes couldn’t be higher.

“Due to the outstanding work with our partners in Colombia and elsewhere, Makled-Garcia is behind bars and awaiting extradition to the United States for the crimes in this indictment,” ventured DEA Acting Administrator Michele Leonhart.

More than most career government bureaucrats, Leonhart, a veteran of more than 20 years in the U.S. War on Drugs, has had an experience of the surreal which is unique in government service.

But in her zeal to acquire drug trafficker Walid Mackled, a $25 chip in a high stakes game of Liar's Poker pitting the U.S.’s ongoing propaganda onslaught against stubborn and recalcitrant Venezuelan strongman Chavez, Leonhart has stepped blindly into the Twilight Zone.

The Arithmetic of Corruption

“His (Mackled’s) arrest will impact worldwide supplies of drugs,” she stated.
“We are committed to ensuring he faces justice in the United States.”

Oh yeah?

The idea that arresting a drug trafficker responsible for shipping ten tons of cocaine a month U.S. in any way equates with taking ten tons of cocaine off the street’s of America is so absurd as to be almost beneath comment.

In reality, all it does is create a marketing opportunity for someone else’s ten tons of cocaine. As Leonhart well knows, this is the Drug War’s big dirty secret.

Leonhart is currently awaits Senate hearings to confirm her appointment by President Obama to head the DEA.

Back in what no would argue were the more open days of the Bush Administration, then-White House drug czar John Walters stated that a gram of pure cocaine in 1981, the year the U.S. government began collecting data, fetched $600.

By contrast, the price of pure cocaine in 2007, Walters acknowledged to Sen. Charles Grassley, citing data from the DEA, was about $135 per gram, and it had hovered near the same level since the early 1990's.

The consenus cost of the War on Drugs, a senior Harvard economist recently told CNN, is $44 billion a year.

Meaning we as a nation spent more than $700 billion dollars... for nothing.

But given the fervor of U.S. efforts in Colombia and elsewhere, there is clearly something going on.

Meanwhile back at the mysteriously unexplained missile launch in Los Angeles so inconveniently caught on tape by a KCBS cameraman, a Pentagon spokesman was busy telling anxious Californians that they didn’t see what they thought they saw.

That missile launch came from a Chinese sub. China got stiffed with "salted gold bars" from Fort Knox, where...The Military protects our Gold Reserves. And, those Gold bars were melted down and cast around TUNGSTEN BLANKS.

And, once again, a joker punk pimp named ERIC HOLDER, and his clown fed dingbat covey at FBI, sit around wondering "just what they should do" about a NO KNOCK RAID ON THE MILITARY GUARDING FORT KNOX SALTED GOLD BARS?
