Distorting public opinion on torture investigations

Last Friday, CNN hosted a panel debate on torture and investigations with two conservatives and two liberals (Daily Kos' David Waldman and Center for American Progress' Erica Williams). Waldman did a genuinely masterful job of arguing the case against torture and for investigations -- you can watch the five-minute segment here -- but, bizarrely, the representative for CAP joined in with the two conservatives against Waldman to insist that there be no investigations. This is what she said:



The American people right now are actually not interested in this sideshow and this discussion. The American people are interested in looking forward -- nobody is concerned anymore with what the Bush administration was doing and did. We decided it was torture. Conservatives may or may not disagree. None of that matters at this point and time.

Thus, we got a "tyranny of good intentions" on the surface, that is actually a TYRANNY OF BAD INTENTION in practise.





1) No LEGITIMATE FISA CT ORDER TO WARRANT A "breakin, and involuntary surgical procedure to insert an RFID MIND CONTROL CHIP in my head" was ever procured legally with an honest, professional FISA CT JUDICIAL TRIBUNAL WHO ACTUALLY FOLLOWED THE FISA LAW AND ALSO SWORE IN FBI AGENTS".

HOW long can you "chip a witness", and after the FISA CT ORDER EXPIRES, then,...uh...how do you take the chip out, without a warrant to remove the chip? Is there a warrant to introduce a sedative to take out the RFID TRACKING--MIND CONTROL--THOUGHT READING CHIP?

Didn't GLEN FINE (testifying in front of Leahy) allude to "FBI conducting a search after their investigation was over with?" Was FINE alluding to the theft of my x rays, and the chicanery when my doctors were flipped by FBI--CIA to falsely report test results while also "hiding the x rays" so I did not have the evidence for a civil suit?

That's why I sought relief in SIOUX FALLS, SOUTH DAKOTA FED COURT...and...again...that is why DIRECTED ENERGY WEAPON ATTACKS AND MIND CONTROL ATTACKS USING THE CHIP were employed. No ENHANCED INTERROGATION to obtain info, just ENHANCED TORTURE TACTICS TO DISABLE, CONFUSE, MISDIRECT, NEUTRALIZE THE THREAT OF A FED COURT FILING.

This, "run him down, run him out of town" and...avoid exposure and possible impeachment...was the spur of the moment strategy that has not been INVESTIGATED WITH A SPECIAL PROSECUTOR. I also got fried in April, 2009, in Boulder City, Nevada, with INFRAGUARD AND BOULDER CITY PD coordinating with the GPS in my car (a 24 year surveillance using GPS without warrant?).

I tried to get HOLDER to SUBPOENAE AND INTERROGATE "FBI--NSA--NON EXISTENT INFORMANTS--FISA CT JUDGES" used in THE BOGUS EX PARTE WARRANT APPLICATIONS that have already proven to be based on IRRATIONAL NEGLIGENT SIGINT INTERPRETATIONS (The Jerky Boys Comedy Album sting operation that I set up on FBI--CIA--DOD--SFPD--APD--NSA).

FBI has problems with FISA CT ORDER procurred through fraud, and a secret conspiracy in which the Judges joined the conspiracy and rubberstamped anything, and JUDGES DID NOT SWEAR IN FBI WITNESSES? That is a red flag that FISA CT OBSTRUCTED MY RIGHTS AWAY WITH MUELLER HEAVILY INVOLVED IN OBSTRUCTING JUSTICE.

2) FBI AND LAW ENFORCEMENT violates TITLE III everyday while violating the fed prohibition on "Dissemination of Illegally obtained info" in violation of the fed wiretap statute (Title 18USC section 2517). Law enforcement changes dates on illegally made tapes, and then lies about how the "newly fraudulently dated tapes" were recorded within the time period allowed under a later, bogus state a/o fed warrant.

I think HOLDER needs to ask for polygraphs, since...some of the principle players are still DOJ employees, and "all DOJ employees must take polygraphs if requested" or they are routinely asked to resign.

No comment from either, LEAHY, CONYERS, HOLDER, asking for my testimony?

Remember, THE TORTURE HAD NO RATIONAL, REASONABLE RELATIONSHIP TO SEEKING ANY INFORMATION TO PREVENT A CRIME OF VIOLENCE.

I wonder how Williams reconciles her claims about what "the American people" are and are not interested in with this:



That poll was from February, and while some subsequent polls have produced different results, all polls -- even the most recent ones with the most anti-investigation findings -- find that, at minimum, roughly 40% of Americans believe there must be some form of investigations in Bush crimes. That's a lot of people to be dismissing away as "nobody."

And Democrats in particular -- the group ostensibly represented by CAP and which chose Barack Obama as their nominee -- overwhelmingly favor either criminal prosecutions or investigations. Williams' claim that "nobody is concerned anymore with what the Bush administration was doing and did" is patently false and, more to the point, is a fringe position among Democrats and progressives. Is that really the position CAP wants to be articulating on CNN?



What makes her claims even more strange is that it contradicts what CAP itself seems to be doing. Here is an article that the main website for American Progress, the entity Williams represents, is currently promoting:



That's an odd article to be running given that, according to Williams, it's a topic about which "nobody is concerned." And CAP's blog, ThinkProgress, has some of the best and most comprehensive coverage around of the debates over torture and investigations.

This happens all the time in our political debates.

Rather than argue the substance of the issue, there is this virtually compulsive need to assert -- with no evidence -- that "the American people" believes a certain way and that anyone who believes otherwise is fringe and isolated.

There's just no denying the fact that, as evidence of the depth of our national crimes continues to emerge, there is increased attention across the political spectrum being paid to these issues. In today's New York Times alone, Frank Rich lays out the case for why investigations are critically necessary, and Maureen Dowd -- in an uncharacteristically cogent and substantive column -- ends with this:



I used to agree with President Obama, that it was better to keep moving and focus on our myriad problems than wallow in the darkness of the past. But now I want a full accounting. I want to know every awful act committed in the name of self-defense and patriotism. Even if it only makes one ambitious congresswoman pay more attention in some future briefing about some future secret technique that is “uniquely” designed to protect us, it will be worth it.


If CAP wants to have its representatives arguing against torture investigations, that's its prerogative, but it really shouldn't be making claims about what the "American people" and especially Democrats believe when those claims are so clearly false.

UPDATE II: CAP's Matt Yglesias disassociates himself from Williams' comments, noting that:

-- (1) "it’s not factually accurate to say that the American people don’t want an investigation";

-- (2) part of CAP's stated goal is "try to shape public opinion," not blindly follow it;

-- (3) "some form of accountability for what happened in the past is important"; and

-- (4) other CAP officials have called for investigations and proceedings against Bush DOJ lawyers [though, to my knowledge, all of them, including Yglesias, oppose (or at least have serious reservations about) prosecutions regardless of whether Bush officials broke the law].

In Dowd's column today, she noted that "very few watchdogs — in the Democratic Party or the press — were pushing back against the Bush horde in 2002 and 2003, when magazines were gushing about W. and Cheney as conquering heroes."

There's no doubt about that (and Dowd notably fails to mention that both she and her newspaper were among the guiltiest media parties in that regard).

But it is that exact same faction -- the Democratic Party establishment in conjunction with the establishment media -- taking the lead once again in shielding and protecting Bush officials who repeatedly broke the law.




UPDATE III: Kudos to Erica Williams for her acknowledgment of error. Our political discourse would be vastly improved if more people were willing to offer such straightforward and authentic apologies for their mistakes. As I've said any times, what determines one's credibility isn't whether they make mistakes, since everyone makes those. What is credibility-determinative is how one responds to one's errors, and Williams responded about as well as possible.

CIA Contractors Played Big Role In Interrogations

Morning Edition, May 15, 2009 · Congressional testimony this week showed that private CIA contractors were a driving force behind harsh interrogations. Although there are lawsuits against military contractors involved in detainee abuse, there has been far less legal action against contractors who worked for the CIA.

American Civil Liberties Union attorney Ben Wisner believes this is largely because of the secrecy that has surrounded the CIA's interrogation and detention program.

"There simply have not been a lot of lawsuits related to the CIA's torture program against either the CIA or its contractors, because courts have almost universally been shutting these lawsuits down on the basis of overbroad secrecy claims made by the CIA," says Wisner.

President Obama and Attorney General Eric Holder have said CIA agents who followed the Justice Department's legal advice won't be prosecuted criminally, but they have said nothing about contractors.

Criminal or civil lawsuits against CIA contractors would present their own unique legal challenges.

In 2006, Congress passed a bill called the Military Commissions Act that includes a provision immunizing contractors from lawsuits. Some lawyers believe that provision is unconstitutional, but no court has weighed in on the law.

The Justice Department memos defining torture are silent about contractors. At a congressional hearing Wednesday, subcommittee Chairman Sheldon Whitehouse (D-RI) asked Georgetown Law professor David Luban about the omission.

"I don't recall any specific mention of private contractors" in the memos, said Luban.

"I don't recall it either," replied Whitehouse, "and it would seem that might raise legal issues. It's interesting that would be a fact in the lengthy opinions that never appears to have surfaced."

When Leon Panetta took charge of the CIA a few months ago, he banned contractors from interrogating detainees. Director of National Intelligence Dennis Blair talked about the decision at a roundtable with reporters.

"It seems to me that those who do these sorts of interrogations of the most important detainees should be government employees," said Blair. "They shouldn't be contractors; they should be highly trained — very supervised."

The full significance of the decision to bar contractors from CIA interrogations was not immediately clear. Then on Wednesday, a former FBI interrogator testified that CIA contractors were the people on the ground who pushed hardest for abusive interrogations in 2002.

Former interrogator Ali Soufan helped question Abu Zubaydah — the first high-value detainee in American custody.

"The interrogation team was a combination between FBI and CIA, and all of us had the same opinion that contradicted with the contractor," said Soufan. "The contractors had to keep requesting authorization to use harsher and harsher methods."

Soufan's written testimony said contractors used nudity, sleep deprivation, loud noise and temperature manipulation against Zubaydah, even before the Justice Department provided legal permission in writing.

Soufan said the contractors did not have any experience in interrogations. They reportedly came from a school where the Army trained American personnel to resist torture.

Trainers from the military school created a private company called Mitchell Jessen & Associates. No one from the company has spoken publicly in the past few years, and they could not be reached for this story.

For attorneys representing detainees, the secrecy surrounding these issues is immensely frustrating. "Everything my client says is presumptively top secret and I'm prevented from revealing it," says Brent Mickum, the attorney for Abu Zubaydah. Mickum is not allowed to discuss whether contractors interrogated Zubaydah, which techniques they used, or anything else Mickum has learned from conversations with his client. That makes bringing a lawsuit against contractors extremely difficult.

"The issue of oversight is the principal concern," says Richard Friedman, president of the National Strategy Forum and an expert on contractors in wartime. "When we get to oversight, who are the overseers and what criteria do the overseers adhere to?" Those are questions that remain unanswered.

Attorney Susan Burke has a long-running lawsuit against military contractors who abused detainees in Iraq. "These are publicly traded corporations, they're reporting a profit to Wall Street, and a significant amount of time they're profiting from is spent in illegal conduct, in torture," says Burke. "It's appalling. And it really needs to draw much more serious consequences than it has to date."

The ACLU says to keep an eye out — as more information is declassified, attorneys expect to bring more lawsuits, including, perhaps, against CIA contractors.
